Alternative Dispute Resolution

Alternative Dispute Resolution (ADR), including mediation, negotiation and arbitration, is becoming increasingly important as changes to litigation funding and reduced legal aid encourage alternatives to court proceedings.

Members of chambers regularly assist individuals and organisations in resolving disputes efficiently and cost-effectively without litigation. Mediation can deliver quicker outcomes, significantly reduce legal costs, and minimise the stress of court proceedings, while still resulting in legally binding agreements.

Our civil mediators handle a broad range of disputes including neighbour disagreements, boundary and building disputes, unpaid debts, and workplace issues. As courts increasingly expect parties to consider ADR before issuing proceedings, mediation offers an effective route to settlement.

Mediation also plays an expanding role in family law, with many court applications requiring parties to explore mediation first. Our family mediators support clients across disputes involving children, divorce, separation, and financial arrangements.

3DJB offers family mediation with trained and experienced family law barristers and mediators. Mediation provides a confidential, voluntary process where an independent mediator facilitates constructive discussion and agreement without court intervention.

Mediations can be held at Chambers or at venues tailored to the parties’ needs. While mediators remain impartial and do not provide legal advice, their experience as barristers enables them to provide up-to-date legal information to support resolution.
